Queensland Government commitment
The Queensland Government has made a commitment to provide access to information held by the government, unless on balance it is contrary to the public interest to provide that information.
The Right to Information Act 2009 (Qld) (RTI Act) and the Information Privacy Act 2009 (Qld) (IP Act) came into effect on 1 July 2009, and provide formal methods of accessing documents held by the government.
Applications for documents under the RTI Act and the IP Act are intended to be necessary only as a last resort. This is because it is the government’s preference to provide information administratively where appropriate, avoiding the need for applications under the RTI and IP acts.
The IP Act also provides a formal method for individuals to apply to amend their personal information in documents held by the government, which the individual believes is inaccurate, incomplete, out of date or misleading.
Is the information you're looking for already available?
The Trade and Investment Queensland (TIQ) website provides a wide range of information about our agency, its functions and activities.
You can also check to see if information you are seeking is already publicly available online through our:
- site search
- publication scheme, which contains information about our services, priorities, finances, policies, lists and registers that we routinely release
- open data datasets that are accessible on the Queensland Government’s Open Data Portal
- and released Cabinet documents, ministerial statements and diaries on The Cabinet and Ministerial Directory.
If you cannot find what you are looking for, the information you are seeking may be available through an ‘administrative release’ process.
What is administrative release?
Administrative release refers to the release of government-held information without the need for a formal request under the RTI Act and IP Act. It is an easier, faster and cheaper way to access information.
Right to Information and Information Privacy access or amendment applications to TIQ are processed by TIQ.
Trade and Investment Queensland will help determine if the information is accessible through an administrative access process, or will advise if you need to make a Right to Information or Information Privacy access application to access it.
If you would like to discuss applying for administrative release of information, please contact us via email at Integrity@tiq.qld.gov.au
How to make an application for documents under the RTI Act
If you would like any documents that contain information other than your personal information, then you will need to apply under the RTI Act – fees apply for applications under the RTI Act.
To make an application under the RTI Act for access to documents that TIQ hold, you can submit yourRTI access application online.
For any enquiries about RTI related matters, contact RTIandIP@desbt.qld.gov.au
If the application includes access to any document containing the applicant’s personal information, then the applicant must provide evidence of their identity with the application or within 10 business days of making the application (e.g. a certified copy of the applicant’s driver licence).
If the application is made on behalf of another person or entity (as their agent), we also require evidence of the agent’s identity, as well as evidence of their authority to act as an agent for the applicant (e.g. a signed written authority authorising the agent to make the application on behalf of the applicant).
How to apply to amend your personal information under the IP Act
If you are only seeking documents that contain your personal information, then you may apply under the IP Act – in most cases there is no fee for applications under the IP Act. See the ‘More information’ section below for details about current fees and charges.
To make an application to amend your personal information, complete and submit the printable Information Privacy Personal Information Amendment Application form via email to Integrity@tiq.qld.gov.au
The applicant must provide evidence of their identity with the application or within 10 business days of making the application (e.g. a certified copy of the applicant’s driver licence). If the application is made on behalf of another individual (as their agent), evidence of the agent’s identity is also required, as well as evidence of their authority to act as an agent for the applicant.
What to do if you are not satisfied with the outcome of your application
If you are not satisfied with the decision made by Trade and Investment Queensland in relation to your Right to Information or Information Privacy application, you are able to seek a review of the decision.
You can do this by:
- requesting an internal review within 20 business days of being told of the decision.
